Epic Hamster (referred to in these terms and conditions as "Epic Hamster", "we", "us" or "our") is committed to protecting your privacy on-line. We will use the information we collect about you to provide games and services to you, which includes, but is not limited to, our online games available through social-networking sites, our websites, and our applications for mobile devices (the "Service"). We appreciate that you do not want any personal information you provide to us distributed indiscriminately and here, we explain how we collect information, what we do with it and what controls you have.

  2. You may access the Service via the Epic Hamster Website, a social-networking website such as Facebook, or other websites where we may decide to offer the Service ("Entry Point Site") by clicking on one of our games icons, or by using any other system supported by the Entry Point Site.

    When you access the Service through the Entry Point Site, we will collect the personal information you have provided to the Entry Point Site (such as your name, e-mail address, postal address, telephone/mobile number, your gender and date of birth) from the account you have with such Entry Point Site. This allows us to provide a personalised service to you. The information we collect may depend on the specific privacy settings you have set with the Entry Point Site. You hereby consent to Epic Hamster access to and collection of such personal information about you. We will create an account for your use of the Service based on such information ("Epic Hamster Account") and you will become a user of the Service. We may also ask that you provide other information to us for your Epic Hamster Account. We will also use the information obtained from your Entry Point Account to create your Epic Hamster Account and to link your Epic Hamster Account to your Entry Point Account.

    You are under no obligation to provide such information. However, if you should choose to withhold requested information, we may not be able to provide you with the Service.

    Please note that sometimes on particular web pages on the Service we will require you to provide additional personal information. When we do this we will specify further on these web pages why we are collecting your information and how we will use it.

    If you access the Service, or play one of our games on your mobile device, including mobile phones and tablets, then we may also collect your mobile identifiers, including MAC address and IPs address.

    When you contact our customer support team, we collect and store the information you provide, the information about your usage of the Service, and the correspondence and any information contained within.

    We do not store any payment information such as credit card numbers or security codes when you make a purchase.

  4. Information you submit via the Service is sent to computers located in Poland and the European Economic Area ("EEA"). Information we collect may be transferred to, stored and processed by, our subsidiaries as well as Epic Hamster's service providers and to other reputable third party organisations, which may be situated outside the EEA. In addition if you use our services while you are outside the EEA, your information may be transferred outside the EEA in order to provide you with those services.

    By accessing the Service, you agree to the collection, transfer, storage or processing of information about you for the purposes described in this Privacy Policy. Epic Hamster will take all reasonable steps to ensure that information about you is treated securely in accordance with this policy and that all information you provide to us is stored on Epic Hamster's secure servers or those of our service providers.

    • create your account and allow usage of the Service;
    • monitor, develop and improve the Service, services and your experience;
    • assist in and administer the provision of services to you (i.e. dispatch news and Epic Hamster communications via email, post, fax or phone, provide you with password reminders or to notify you that a particular service has been suspended for maintenance);
    • process and deal with any complaints or enquiries made about you;
    • contact you about a submission you have made to the Service, including any content you provide;
    • provide technical support and respond to your enquiries;
    • deliver advertising;
    • understand customer trends and patterns.

    • in relation to the functioning of any service you have signed up for in order to ensure that we can deliver the services to you;
    • where you have opted to receive further correspondence
    • in relation to any contribution you have made to the Service, e.g. on our message boards;
    • to invite you to participate in surveys about our services (participation is always voluntary); and
    • for marketing purposes where you have specifically agreed to this (see paragraph 5 below)

  9. Will I Be Contacted For Marketing Purposes?

    • send you and keep you updated with information by email, telephone (including SMS) or mail about existing and new services, products and special offers from us; and/or
    • send you information by email, telephone or mail about related products or services of selected third parties that may be of interest to you

    We may occasionally contact you about products and services we feel may be of interest to you. This will only come from us (or our agents) and only if you have indicated that you do not object to these offers.

    You always have the opportunity to remove your consent to such use by sending an email to help@EpicHamster.com with your request.

    We will not send you unsolicited premium rate SMS messages (which are SMS messages you pay to receive), although your service provider may impose a charge on messages that you receive. Please check with your service provider for details.

    You can tell us not to contact you or share the information with a third party either at initial registration or later through updates or amendments to your personal information. In this case we may still contact you for non-marketing purposes, for example to answer one of your queries, or to provide you with information about a payment transaction, or any other such legitimate usage.

  11. Will We Share Your Personal Information With Anyone Else?

We will keep your information confidential except where disclosure is required or permitted by law (for example to government bodies and law enforcement agencies) or as described in paragraph 7. Generally, we will only use your information within Epic Hamster and Epic Hamster's subsidiaries. However, sometimes Epic Hamster use third parties to process your information. Epic Hamster will require these third parties to comply strictly with its instructions and will require that they do not use your personal information for their own business purposes.

    The Service may also support and encourage interaction among users. If you access the Service through a social-networking site, then your social-networking friends may see some information related to your game activity. Other users may also be able to access some of this information, through leader-boards for example.

    We do not share personal information with third party advertisers. We may share aggregated information, such as behaviour and usage pattern, but no information identifiable to you.

    In the event that Epic Hamster undergoes a business transition, such as merger, acquisition by another company, or sale of all or a portion of its assets, we may transfer some or all of your information to the successor organization. If this event was to have an impact on our privacy policy, we would notify you by publishing on the Service before transmitting your information.

  13. Offensive Or Inappropriate Content On the Service

If you post or send offensive, inappropriate or objectionable content anywhere on or to the Service, or otherwise engage in any disruptive behaviour on the Service, we may use your personal information to stop such behaviour. Where we reasonably believe that you are or may be in breach of any of applicable laws (for example, but without limitation, content you have posted may be defamatory), we may use your personal information to inform relevant third parties such as law enforcement agencies about the content and your behaviour.

  16. You must be at least 13 years of age or older in order to use the Service. If we become aware that you are under 13 and are attempting to or have submitted personal information via the Service, we will not accept such information and we will take steps to remove such information from our records. This may involve us having to access and verify your age and other relevant details.

  17. Keeping Our Records Accurate

  18. We aim to keep our information about you as accurate as possible, but we depend on our users to update their personal information held on the Entry Point Site whenever necessary. You can review, change or delete the details you have supplied to us at any time by emailing help@EpicHamster.com.     If you access the Service through a social-networking website, you will need to contact them and follow their instructions, possibly changing your privacy settings, to update the information we receive from them about you.

  19. Limitation Of Liability

  20. The Service may contain links to other websites where information practices may be different to ours. For example, if you "click" on a link, the "click" may take you off the Service. Visitors should consult the other websites' privacy notices as we are not responsible for and have no control over information that is submitted to, or collected by, these third parties.

    We may use a reputable third party to present or serve the advertisements that you may see at the Service. This Privacy Policy does not cover any use of information that a third-party ad server may have collected from you.

  22. We are not responsible nor will be liable to you in any way for events beyond our direct control. Because of the complex and constantly changing nature of our technology and business, we cannot guarantee nor do we represent that our performance will be error free, and to the maximum extent permitted by law we will not be liable for any direct, indirect, incidental, consequential or punitive damages or other loss suffered by you and relating to the use or release of your personal information.

  23. How Long Will We Keep Your Personal Information?

  24. We will hold your personal information on our systems for as long as is necessary for the relevant service, or as long as is set out in any relevant contract you hold with Epic Hamster. In the case that you wish to cancel your registration as a Service member, once an account is deleted, while people cannot use the personal information, we reserve the right to keep the information on our systems for a reasonable period of time, for administration purposes.

    Where you contribute to the Service, we will generally only keep your content for as long as is reasonably required for the purpose(s) for which it was submitted.

  25. Can I Find Out What Personal Information We Hold About You?

  26. Under the Data Protection Act 1998 you have the right to request a copy of the personal information we hold about you and to have any inaccuracies corrected. We charge 100.00 PLN for information requests and will require you to prove your identity with 2 pieces of approved photographic identification. We will use reasonable efforts to supply, correct or delete personal information about you on our files.

  27. Accessing the Service Outside Poland

  28. The Service is published in Poland by Epic Hamster. All personal information submitted by you to the Service will be processed in accordance with this Privacy Policy (and any local terms that apply on the Service) unless terms on the Service specify otherwise.

  29. Languages of the Privacy Policy

  30. This policy is written in English. The translation of this policy is made with the sole aim of facilitating understanding. In case of difference between the English and any translated version, the English text will prevail.

  32. We reserve the right, from time to time, and at our sole discretion, to change or update this Privacy Policy.

    All changes to this Privacy Policy will be published on this page and on the Service. Upon publication, each change will become effective and you will be deemed to be aware of and bound by it. You should therefore review this Privacy Policy regularly to ensure that you are up-to-date with the current terms of the Privacy Policy.

  33. Cookies and Web Beacons

  34. Cookies are pieces of information that a website transfers to your hard drive to store and sometimes track information about you. Most web browsers automatically accept cookies, but if you prefer, you can change your browser to prevent that. However, you may not be able to take full advantage of a website, or in this case the Service, if you do so. Cookies are specific to the server that created them and cannot be accessed by other servers, which means they cannot be used to track your movements around the web. Although they do identify a user's computer, cookies do not personally identify users and passwords and credit card information are not stored in cookies.

    We may use cookies to:

    • identify who you are and to access your account information;
    • estimate our audience size and patterns;
    • control how often visitors see similar ads; and
    • track preferences and to improve and update the Service.

    We use third party analytics platforms such as Kontagent and Google Analytics to help analyse where visitors go and what they do while visiting our Service. These analytics platforms do not hold any personal data.

  35. Security

  36. The Service has security installed to ensure that any personal data entered onto the Service is protected against loss, misuse or alteration. However, due to the nature of the Internet, we can't guarantee the protection of your personal information and we can't be responsible for any outcomes resulting from a breach of security when the Service is used. We're confident in our security, and it is always a top priority to ensure we do not get any problems.

    While we're confident about our security measures, the transformation of information over the internet is not completely secure and we cannot guarantee the security of the data while it's being transmitted from your computer or mobile device to the Service. Once the Service has received your information then we have procedures and security in place to try to prevent any unauthorized access.

    Some of the data we hold can be accessed through your account, or the account of the social-networking site you used to get access to the Service. In consequence, we urge you to take all required steps to protect your passwords, including the password you used to access the service through a social-networking site. We also urge you to log out of your account after use. You need to immediately contact us if you suspect any unauthorized access of your account.
